End User License Agreement
This document (“EULA”) is a legal agreement between you (as an individual or entity) and ROCKET POWERED SOUND Inc. for all ROCKET POWERED SOUND Inc. software, media and documentation, including any updates and/or new versions of the software (the SOFTWARE PRODUCTS). By installing, creating an account, and/or otherwise using any ROCKET POWERED SOUND Inc. SOFTWARE PRODUCTS, you agree to be bound by the terms of this EULA. This license agreement represents the entire agreement concerning the program between you and ROCKET POWERED SOUND Inc., and it supersedes any prior proposal, representation, or understanding between the parties. If you do not agree to the terms of this EULA, do not install or use the SOFTWARE PRODUCTS. The SOFTWARE PRODUCTS are protected by copyright laws and international copyright treaties, as well as other intellectual property laws and treaties.
Use
The SOFTWARE PRODUCTS are licensed, not sold. The purchase of the SOFTWARE PRODUCTS grants you one license for the software to use on all operating systems on all computers owned by you, provided you are the primary user of the computer.
Businesses and organizations must purchase a license for each user of the software.
Rights and Limitations
The provided SOFTWARE PRODUCTS can be used for commercial or non-commercial music and audio productions without the prior permission from ROCKET POWERED SOUND Inc.. All ROCKET POWERED SOUND Inc. software may be used to create samples for commercial products such as sample packs and sound libraries.
You are not permitted to redistribute presets, samples, wavetables, skins, LFOs or other media created from any unaltered ROCKET POWERED SOUND Inc. content distributed with the SOFTWARE PRODUCTS.
You may only use web services accessed by the SOFTWARE PRODUCTS through normal use of the software. You may not automate requests, scrape, or access these web services from outside the SOFTWARE PRODUCTS.
You may not reverse engineer, decompile, or disassemble the SOFTWARE PRODUCTS, except and only to the extent that such activity is expressly permitted by applicable law notwithstanding this limitation.
ROCKET POWERED SOUND Inc. may provide you with support services related to the SOFTWARE PRODUCTS (“Support Services”). Any supplemental software provided to you as part of the Support Services shall be considered part of the SOFTWARE PRODUCTS and subject to the terms and conditions of this EULA.
You must comply with all applicable laws regarding use of the SOFTWARE PRODUCTS.
Copyright
All title, including but not limited to copyrights, in and to the SOFTWARE PRODUCTS and any copies thereof are owned by ROCKET POWERED SOUND Inc. or its suppliers. All title and intellectual property rights in and to the content which may be accessed through use of the SOFTWARE PRODUCTS are the property of the respective content owner and may be protected by applicable copyright or other intellectual property laws and treaties. All rights not expressly granted are reserved by ROCKET POWERED SOUND Inc.
Warranty and Limitation of Liability
THIS SOFTWARE IS PROVIDED TO THE USER “AS IS” AND ANY EXPRESS OR IMPLIED WARRANTIES, INCLUDING, BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE ARE DISCLAIMED. IN NO EVENT SHALL THE COPYRIGHT HOLDER BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, OR CONSEQUENTIAL DAMAGES (INCLUDING, BUT NOT LIMITED TO, PROCUREMENT OF SUBSTITUTE GOODS OR SERVICES; LOSS OF USE, DATA, OR PROFITS; OR BUSINESS INTERRUPTION) HOWEVER CAUSED AND ON ANY THEORY OF LIABILITY, WHETHER IN CONTRACT, STRICT LIABILITY, OR TORT (INCLUDING NEGLIGENCE OR OTHERWISE) ARISING IN ANY WAY OUT OF THE USE OF THIS SOFTWARE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGE.
